⚠ IMPORTANT: These Terms reference our Refund Policy (limited refunds available within 14 days on a discretionary basis) and include an arbitration clause (Section 12). By accessing or using Alien Escape, you agree to be bound by these Terms. If you do not agree, do not use the service.

1. ACCEPTANCE OF TERMS

By accessing, playing, or purchasing a subscription to Alien Escape ("the Game," "Service"), you ("User," "you") agree to these Terms and Conditions ("Terms") in full. These Terms constitute a legally binding agreement between you and Alien Escape ("we," "us," "our"). If you are under 18 years of age, you must have parental or guardian consent to use this Service and to make any purchases.

2. DESCRIPTION OF SERVICE

Alien Escape is a free-to-play browser-based endless runner game. The game is available in a free tier (supported by advertisements) and optional paid subscription tiers that offer additional features including ad removal, exclusive character skins, and gameplay bonuses. All features are described on our Pricing page.

3. USER ACCOUNTS AND ACCESS

Alien Escape does not require account registration to play the free tier. Game progress is stored locally in your browser's localStorage. Subscription status is verified by Paddle and stored locally. You are responsible for maintaining access to your device and browser where game data is stored. We are not responsible for data loss due to browser clearing, device change, or technical failure.

4. SUBSCRIPTIONS AND BILLING

Paid subscriptions are offered on monthly, annual, and lifetime basis at the prices listed on the Pricing page. All payments are processed by Paddle.com Market Limited, our Merchant of Record. By purchasing a subscription you agree to:

You may cancel a recurring subscription at any time via Paddle's customer portal. Cancellation takes effect at the end of the current billing period. You retain access to premium features until the period ends. See our Refund Policy for details on any refund eligibility.

5. SUBSCRIPTION FEATURES

Features included in each subscription tier are described on the Pricing page. We reserve the right to modify, add, or remove features at any time with reasonable notice. If we substantially reduce features included in your active subscription, you will be notified and offered a prorated adjustment or the option to cancel.

7. REFUNDS

Purchases of subscriptions and premium features are generally non-refundable due to immediate delivery and access upon payment. We offer limited refunds as described in our Refund Policy, including a 14-day discretionary money-back guarantee reviewed case-by-case (especially for technical issues or where required by consumer protection laws). 8. INTELLECTUAL PROPERTY

All content in Alien Escape, including but not limited to the game engine, artwork, character designs, alien designs, planet themes, music, sound effects, and branding, is the exclusive intellectual property of Alien Escape. No content may be reproduced, distributed, or used commercially without express written permission. The game is an original work and is not affiliated with, endorsed by, or connected to any third-party game or intellectual property.

10. DISCLAIMERS AND LIMITATION OF LIABILITY

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. To the maximum extent permitted by law, Alien Escape shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service or inability to use the Service, even if advised of the possibility of such damages. Our total liability shall not exceed the amount you paid to us in the 30 days preceding the claim.

11. INDEMNIFICATION

You agree to indemnify and hold harmless Alien Escape and its operators from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from your violation of these Terms, your use of the Service, or your infringement of any third-party rights.

12. DISPUTE RESOLUTION

Any disputes arising from these Terms or the Service shall first be attempted to be resolved through informal negotiation by contacting us directly. If not resolved within 30 days, disputes shall be subject to binding arbitration in accordance with applicable arbitration rules. You waive any right to participate in class action lawsuits against Alien Escape. Nothing in this clause prevents either party from seeking emergency injunctive relief from a court of competent jurisdiction.

13. GOVERNING LAW

These Terms are governed by and construed in accordance with the laws of England and Wales (consistent with Paddle's jurisdiction as Merchant of Record for payment matters). For payment-related disputes, Paddle's terms may apply. Disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales, unless otherwise required by mandatory consumer law in your jurisdiction.

14. MODIFICATIONS TO TERMS

We reserve the right to modify these Terms at any time. Material changes will be communicated by updating the "Last updated" date on this page and, where possible, via email or in-app notice. Your continued use of the Service after modifications constitutes acceptance of the updated Terms. If you do not agree to the revised Terms, you must stop using the Service.
